Selling privately · Car loans
How to sell a car you still owe money on
You can sell a car with a loan on it. The lender has to be paid off before the title can go to your buyer, so the whole sale comes down to the order things happen in. These six steps keep you and your buyer covered.
Step 1: Get your payoff amount
Your payoff isn't the balance on your statement: it includes interest up to a set date. Ask your lender for a payoff quote, usually good for about 10 days, and ask two more questions: how do they want to be paid, and how and when do they release the lien and send the title? Some states keep titles electronically, which is faster than waiting for paper in the mail.
Step 2: Work out whether you owe more than it's worth
Look up your car's private-party value on a pricing guide such as Kelley Blue Book or Edmunds and compare it with the payoff. If the car is worth more, the difference is yours after the sale. If you owe more, that's negative equity, and you'll need to cover the gap from savings or a separate loan, because the lender won't release the title until it's paid in full.
Step 3: Choose how the loan gets paid off
| Option | How it works |
|---|---|
| Pay off first | You clear the loan, wait for the title, then sell with title in hand. Cleanest for buyers, but you need the cash up front. |
| Close at the lender | If your lender is a local bank or credit union, meet the buyer at a branch. The buyer's money pays off the loan and the rest goes to you, all in one visit. |
| Buyer pays, you pay off | The buyer pays you, you pay the lender, and the title follows by mail. Common, but the buyer is trusting you with the payoff, so put it in writing. |
A dealer trade-in is the other route: the dealer pays the lender for you, but usually offers less than a private buyer would.
Step 4: Tell buyers up front
Say in your listing that there's a loan and how you'll handle the payoff, for example "Loan with my credit union, paid off at the sale." Buyers who find out late tend to walk away. Have your payoff letter ready to show serious buyers.
Step 5: Put the plan in writing
Write it into the bill of sale: the lender's name, the payoff amount, who pays the lender and by when, and when the buyer will receive the title or lien release. Both of you sign and keep a copy. Our free bill of sale maker has room for these terms.
Step 6: Close the sale and follow the title
Confirm the buyer's payment is real before you hand over the keys, pay the lender straight away, and keep the payoff confirmation. Then stay on it until the lien release or title reaches your buyer, and sign the title over as soon as you have it. Our guide to transferring a car title covers the signing. Where DriveLink fits
DriveLink protects the payment at the handover. The buyer pays through DriveLink by card, or by wire for larger deals. The payment is processed by Stripe into your own account, and it's released to you once the buyer confirms they have the car, or once you enter the handover code they give you. Agree with your buyer in writing how the payoff and the title will follow.
