Buying & selling privately · New Jersey

New Jersey car bill of sale: do you need one?

For an ordinary private sale of a titled car, the signed title is the legal document the MVC works from. A bill of sale is still worth writing, because it is the only place that records the mileage, the condition you agreed to and the payment in one page both of you keep.

When the MVC asks for one

  • Titled car, private sale: the MVC's pre-owned vehicle page lists the assigned title, Form BA-49, ID, insurance and fees. It doesn't list a bill of sale as a required document for the buyer, but the MVC's page on transferring ownership says the seller should provide one with the buyer's name and address, the sale date, the odometer reading and the price.
  • Vehicle with no title: if you're bringing in a vehicle from a state that doesn't issue titles, or one that has never been titled, the MVC asks for an original, notarized bill of sale showing both parties' names, addresses and signatures, the year, make and VIN, the sale date, the price and a full description. Photocopies are not accepted, and the MVC also wants a VIN verification (a pencil tracing or photo of the VIN plate, or Form ISM/SS-321).

If you're not sure which case you're in, ask the MVC at 609-292-6500 before you pay.

Why write one anyway

  • It records the mileage and VIN as of the day of sale.
  • It states the car is sold as is, which sets expectations for after the handover.
  • It shows the price and how it was paid, which matters if a payment is ever disputed.
  • It gives the seller proof of the date and time the car left their hands.

Compra y venta privada · Nueva Jersey
